Residents Against Tuakau Smells(RATS) action community group was formed by a group of concerned residents of Tuakau, North Waikato(Franklin), New Zealand due to the community being fed up with the denials, excuses and neighbour blaming of ODOURS/DUST/POLLUTION from ENVIROFERT composting and clean?fill facility on River Road/Geraghtys Road and TUAKAU PROTEINS (Waikato By-Products) rendering plant on Lapwood Road.
This Blog is a way of getting information out to the residents that for many reasons do not want to complain or be named!

ENVIROFERT:
Environment Waikato & Franklin District Councils issued resource consents for a clean?fill operation in March 1999, after a joint hearing. Envirofert is owned & operated by GARY PETER MCGUIRE, TUAKAU Director & Shareholder & ANDREW HENRY BAYLY, KARAKA, (NOW MP FOR HUNUA)Director & Shareholder. Under their ownership, Envirofert has had numerous non-compliances, abatement notices, infringement notices, letters of direction and letters of warning!
2013-14 Gary McGuire leaves to train as a St Johns First Response Officer. Tuakau has been left with years of mistakes. Envirofert not built to approved application plan, bund built in wrong location, planned drain not built, now flooding neighbours land, numerous non compliances of consent conditions, unlawful dumping of waste, unlawful discharges to waterways and Waikato River.
2015 McGuire has been sacked from St Johns for disciplinary procedures.

2014 ANDREW HENRY BAYLY,KARAKA (now Member of Parliament for Hunua) Director & Shareholder, off to spend taxpayers money in Wellington while leaving Tuakau to live with the legacy of his many mistakes. Proven non-compliance's of resource consents, environmental contamination, proven illegal dumping in clean?fill, proven illegal discharges to waterways, flooding the neighbours property due to not building a drain in 1999 for clean?fill bund runoff, wrong location of clean?fill bund being over neighbours's boundary by metres and not working to consent conditions. Bayly's still connected to Envirofert.

1998 Land farming green waste was started.
1999 Envirofert started a Cleanfill operation. Gary McGuire (Tuakau local) /Andrew Bayly(Member of Parliament for Hunua)/Paul Bayly(brother of Andrew Bayly) owners and shareholders.
2001 WRC Consent was granted for a Vermiculture & Green waste composting operation.
2002 Overall Site Compliance: Partial Level of Compliance.

2006 Complaints made by neighbours of drain contamination, product blowing onto neighbours land and height of clean?fill.
2008 Envirofert did a one windrow trial for food waste.
2009 Council granted a S127, (change to consent conditions) to take food waste. The reports was done by Tonkin+Taylor, Barker&Associates, and Air and Environmental Sciences Ltd. This change was granted by Waikato Regional Council on a non-notifying basis (community were not informed). Envirofert's neighbours (Waikato By- Products Ltd rendering plant)were doing upgrades and community were advised not to complain about odours while the upgrades were being done. WRC said 'timing was unfortunate' or was it?? McGuire was at the meeting that discussed the upgrades. Not seen at meeting for years.
2010 Envirofert was taken to Environment Court by neighbour with an Enforcement Order. Mediation and nothing achieved, lawyers involved!
2011 Envirofert went into partnership with Fonterra to do food destruction. Food that was past its sell by date, recipes gone wrong, food not fit for human consumption.

Many residents are now complaining about gas/sulphur/tip/waste odours in Bollard Road from Smart Environmental in Industry Lane and the Biodiesel Plant (originally from Carr Street)plant by the gas station.

Andrew Bayly, owner of Envirofert, MP for Hunua states environmental issues.

ANDREW BAYLY, OWNER of ENVIROFERT, MP for HUNUA  states in Franklin County News 23 September 2014 "I very much like environmental issues." Yeah right! 15 years of Bayly being the owner/director of Envirofert. Tuakau has been left with environmental issues. 

35 years on and Andrew Bayly is still making stupid decisions without considering other people and walking away from his mistakes and results. Envirofert aka Envirofart. Good politician material!

Stinking putrid smells from Envirofert continue daily. ALL DAY! Something smells like burning rubber, s#@t, compost, rotten food, rotten green waste and manure. If this is like this in spring, god help us in summer. Councils you should hang your head in shame.

15 years of environmental issues we have had in Tuakau from his Envirofert composting/clean?fill facility. Belching out putrid, gut wrenching, throat burning odours and dust. And Bayly has done nothing, just denied and blamed others. 
Bund not built to plan, over neighbours boundary. Obviously never had the boundary surveyed at the start of construction. No engineering reports for the first few years. 
And now this man is a MP in the New Zealand government.

Gypsum dust flying through the air, from the south west.  We are 1.5 kms away and it went way past us. Winstone Wallboards Material Safety Data Sheet states: Respirable dust may cause lung disease or cancer.
Mike Lord,CEO of Envirofert said 'the farmers would welcome the gypsum on their land', as usual Envirofert not giving a damn about the health risks to children walking to school through clouds of gypsum and the community also breathing in this dust. Mike Lord and his wife have a company called 'Improving Health', they could be causing health issues but could also be making profits out of it??

Bayly's was voted in to government on Saturday September 20th 2014, MP for Hunua. While he was celebrating, Tuakau was living with putrid composting stench from his Envirofert facility,the s#@thole on the swamp. A whole week of stinks, even Sunday! 
Hunua constituents, be prepared to be treated with arrogance from this man, never listening, denying all, and blaming everyone else. He will make an excellent politician.

South westerlies are back and so is the putrid sewage/composting stench from Envirofert in Tuakau, North Waikato, NZ. Council have admitted that this stench is from Envirofert.

11 September 2014 What's in this dust? Springtime, what's is the summer going to be like?

How ironic that Andrew Bayly, owner of Envirofert on River Road, Tuakau is promoting environmental projects in local schools in 'The Post Newspaper' Waiuku. I am sure he forgot to mention to the schools that Envirofert constantly emits putrid, smelly gut-wrenching, and throat burning odours over Tuakau and the surrounding areas. What are Tuakau residents breathing in? This facility is situated on one of Tuakau's wetlands which are now ruined visually and environmentally. The clean?fill area was the filter from Tuakau run-off before it entered the Mighty Waikato River.

This week's 'The Post' 26/08/2014 has a photo with Bayly and others giving grants to local schools for glass recycling. Of course Bayly would promote this as he gets tipping fees at Envirofert as the glass ends up in his so called clean?fill. Truck after truck dumping glass on what once was wetlands that drains into the Mighty Waikato River. Wetlands ruined, dirty discharge into river, noted by boaties and jetski users.Seagulls on the river!

Another photo opportunity for the general elections 2014 in Franklin County News with Bayly and others giving Aka Aka school $2000 grant for the rehabilitation of their existing wetlands.Bayly's Envirofert tip and composting facility is on wetlands that originally filtered water that eventually drains in to the Waikato River. Now it drains through rotting food and green waste, construction and demolition waste, gypsum, silica, glass and who knows what waste and the wetlands are ruined.

Compost sites have become a science experiment gone wrong, producing putrid odour. "Stink Zone" extends up to many kilometres away!

When will councils, governments learn that this can not be done without putrid stinks and therefore it should not be done in residential areas or this close to houses. Again these decisions are made by idiots that don't live in Tuakau, North Waikato, New Zealand.
Envirofert is an odorous facility and all operations should be done under cover. Not trucks backing in, dumping their smelly loads on the ground, windrows being formed and rotting food waste left to rot outside. Hundreds of seagulls!

2nd September 2014:Luckily for the last few weeks we have had mainly easterlies and the stench from Envirofert/ Waikato By-Products/Tuakau Proteins, some other poor person is having to live with. Is it illegal for a facility or industry to pollute your air? The councils don't think so! What do you think? As more and more stinky facilities are allowed to operate the air will become more and more concentrated. 
      Sure there are dishonest men/women in local government. But there are dishonest men?women in national government too!

Wake up Tuakau!

We have the potential to become the SMELLIEST town in the region!

TRIAL TO BE EXTENDED!

Envirofert food waste composting facility in Tuakau, with entrances off River Road/Geraghtys Road is taking Auckland councils food waste from a food waste trial from 2000 households on the North Shore.
This is for 3 months. August 2014(Local Government online) The trial is to be extended. Auckland's food waste collection is to be rolled out in 2016!
How many houses are there in Auckland and how big could this pile of rubbish become?
Then there is the potential to take all of the rotting food waste from Waikato and Bay of Plenty as well. This company will take waste from anywhere to make money with no consideration or respect for it's neighbours lives and health.
It would be better for individuals to do their own composting but alas the human race is sooooo lazy and "someone else will deal with it".
Wouldn't it be better for cities to compost in their own districts, rather than truck this food waste many kilometres? Carbon foot print?
Auckland council has a policy of not taking waste from outside Auckland's boundary but Auckland council seem to think it is alright to chuck their rubbish over the fence in our backyard  in the Waikato.
As long as Auckland don't have to deal with it.
Our mayors, councils and central government don't give a s#*t about Tuakau, THEY DON"T CARE!



One of the owners of this company is ANDREW BAYLY the National Party candidate for Hunua in the upcoming 2014 general elections on September 20th. 
Tuakau WAS in Hunua's electorate for many years but with the recent boundary changes Tuakau is now in the Waikato electorate.
Change the boundaries and get more National supporters, & laws changed??
BAYLY has been a director/shareholder of Envirofert since 1999 the year Envirofert started operating. Green waste and clean?fill problems have been issues with some of the neighbours since 1999. 2009 Envirofert were issued Resource Consents (non-notifying) to take food waste to make compost (stinking compost) which Tuakau community have since been complaining about odours, pollution, dust & trucks. These consents were issued by Waikato Regional and District Councils. 
Understand that basically the finished compost is not a huge problem, it is the start of the journey to make compost, from smelly trucks uncovered with smelly food waste that could have been sitting for weeks. Then the smelly food waste in piles out in the sun rotting and stinking for months.
Fast forward to 2014 and Tuakau are still living with putrid stench. 5 years of not being able to use our property, property values affected,bbq's, washing stinks & house stinks. Summers are ruined by odours, dust and NO-ONE will tell us what is in the VOC contaminants or dust!
If you read Bayly's (former owner) National Parties bio you would think he is as delusional as McGuire the former owner of Envirofert when he started this tip and thought it wasn't going to stink. Maybe it has got something to do with composting.
Is Andrew Bayly going to treat his constituents with arrogance and no respect like he has the Tuakau community?
Food waste composting is a smelly business and we cannot find anywhere  in the world that can do composting without odours. In some cases odour travelling many kms.
How can decent human beings inflict this odorous condition on other humans?
By 2015 ALL ORGANIC WASTE has to be out of landfills and brought to a facility like Envirofert.
Could NIMBY mean not in my back yard or next it might be you.
This has the potential to be horrendous with the facility operating 24/7 with continual polluted air! Never having the right to breath FRESH COUNTRY AIR as the Waikato Regional council say they are the authority to tell Tuakau residents what they consider as ACCEPTABLE!
One hour away from Tuakau!
We had no say in the decision to have Envirofert in Tuakau so this 
could happen in your district. Councils let Envirofert be issued with resource consents that the public had no say in, and the council does nothing until a complaint is made and then the councils do NOTHING. 
Never having someone to verify an odour complaint.

Envirofert review consents.

Envirofert apply for review, replacement of existing Resource Consents 104416,104418,104419.


Under the RMA (S128 review of conditions) reviews/replacement of Resource Consents are done.  On Waikato Regional Council website is 'Recent resource consent activity' that you can look at resource consents, applied, declined or granted. In 2013 the website went down with the explanation of updating the 'database'. That was August and by December it still wasn't up and running. I sent an email to WRC about this and they have since in April got it now updated, nearly 12 months on.  In the October 2013 on the WRC website for recent activity, 3 resource consents are from Envirofert, 104419 (Discharge contaminant to the air associated with a composting and vermiculture operation)- Activity subtype, Air-odour, 104418 (Discharge vermicast liquid from storage ponds to land)-Activity subtype, Land-other, 104416 (Discharge green waste onto land as part of a vermiculture operation)-Activity subtype Land-solid waste.
Peter Stevens of PS Environmental Services Ltd, Hamilton is undertaken these reviews. He is a facilitator for Waikato Regional Council?
Peter Stevens stated in an email that the review of consent conditions may result in changes such as new conditions and alterations to conditions. He also said to be assured that there is NO intention to make changes which could increase effects, rather the purpose of the review is to review the effectiveness of the existing conditions and potentially add new conditions or amend existing conditions to avoid, remedy or mitigate the effects of the activity.
We have concerns about mitigate as the meaning is " to make less severe" and that is not fix the issues. Councils never seem to look at fixing problems just try and use different words that mean the same thing.
These were Council reviews initiated  by William Gauntlett who was Waikato Regional Councils resource officer (now left 2013 works at WDC) with 104419, 104416 due to on-going issues with odours affecting neighbours and 104418 due to risks of adverse effects from leachate run-off and nutrient leaching.
In our view reviewing conditions on these resource consents would normally be for the benefit of Envirofert and not its neighbours. Envirofert has still on-going compliance issues. To be continued. Reports, changes to, & new Resource Consents & conditions to come?
Update: January 2015, Still waiting on the council, no audits have been done as well. well overdue! Is this because they are unable to meet the resource conditions or could it be that they are waiting to see what the outcome of the Waikato District legal counsel investigation into the illegal siting of the clean?fill bund is??

ANDREW BAYLY-National Party candidate!




Andrew Bayly, now the National Party candidate for Hunua in the upcoming 2014 general election is director & shareholder of Envirofert in Tuakau, North Waikato, New Zealand since 1999. Envirofert does composting, green waste, food waste, and who knows what waste, still to be announced waste. 



Turning Compost

 Also at the Envirofert facility in partnership with Fonterra a Depacking and Destruction Shed for food product waste, damaged packaging, contamination, end of shelf life and recipe malfunctions. 
Envirofert also operates a clean? fill. With recent surveying done by Enviroferts neighbour for fencing, the clean?fill and bund have been found to be partly built on neighbours land , Envirofert has no engineering reports to confirm that the clean?fill or bund has been constructed and engineered properly even though the engineering reports were a Waikato Regional Council resource consent condition. Waikato District Council give Land Use.
Trucks dumping?
The plans supplied and the construction of clean?fill  was to be overseen by Robert Tilsey & Barker & Associates. The bund & clean?fill was to be built with a boundary set back of 7 metres + drain. The bund and clean?fill have been built on the boundary & over the boundary in parts & without a drain. So the clean?fill drains onto the neighbours land. Council are not willing to address this problem, stating it is a civil matter. The contract is between the council and Envirofert. The neighbour who has opposed Envirofert since 1998 and was one of 40+ opposing residents. 
Envirofert deny that the drain, clean?fill and bund are in the wrong place.


This is the neighbours drain next to bund. Under the signed off plans Envirofert were to build a drain on their property to drain the runoff from the bund but no drain was built. Bund built in wrong location also. Councils failed the neighbour by not monitoring the owners, Gary McGuire and Andrew Bayly.

Welcome to OUR world.

WELCOME TO THE OUR WORLD

Compost facilities are put in places where people with little money and no political power live, just like cleanfills, landfills, transfer stations, rendering plants, tanneries, incinerators, oil refineries, and chemical plants, concrete plants.

Envirofert composting, greenwaste, clean?fill and Graeme Lowe Waikato rendering plant are a perfect example of that kind of siting.

When Aucklanders, Hamiltonians and all the other cities that use Tuakau as their garbage dumping ground really want to deal with their waste in a way that spreads the actual costs of our lives evenly, all parks in these cities will designate a part of their land to composting and everyone will make sure piles are aerated and properly cared for. 

Until then, the haves will dump their waste on the have nots and the argument put forth will be a dishonest one-"this is a perfect place for a composting facility".

This is a story about the political game that humans play that keeps little people little and the moneyed people in control.

This is great as long as you don't live within 5-6 kms of these facilities.
The most important thing is political pressure and loud voices!
Sadly, science and common sense have been relegated to the back seat!

The true meaning of ORGANIC!

                       'Organic'

Lets be clear about the word 'organic'.
'Organic' compounds, in chemistry, are compounds that contain carbon and usually hydrogen. This means that just about everything is 'organic' in the sense of science.
Human poop is 'organic'. Animal poop is 'organic'. Animal waste is 'organic'.
Any science-defined 'organic' material can be full of toxins, poisons, heavy metals, and other materials that are harmful to humans and the environment.
'Organic' foods WERE grown without the use of artificial fertilisers or pesticides.
'Organic' animal products WERE raised without the use of antibiotic and hormone treatments.
So using 'organic' material does not necessarily result in 'organic' food.
Most composting facilities use the word 'organic' to misrepresent since most people think 'organic' material is "human consumption ready", non-threatening to humans and chemical free.
That couldn't be further from the truth.
They use the word 'organic' as a very clever way to mislead the public.
The human, animal, medical, and food/green waste that will be processed will be full of poisonous heavy metals, toxic chemicals and pharmaceuticals.
This product is what you will be spreading on your garden and your kids will be breathing in the toxins.

 'The food/unpacking area had an unpleasant odour, more putrid, although there was no activity there. A fogging system is for when the food is unpacked. There seemed to be a lot of food waste stored on shelves and pallets'.

Breaking News!!


Envirofert has been issued two Abatement  Notices by Waikato Regional Council  

Waikato Regional Council issued 2 Abatement Notices to Envirofert Food Waste Composting Facility on Thursday 4th April 2013 regarding offensive and objectionable odours.
These were verified complaints from January and February 2013.
The company was fortunate not to have March 2013 included as it was just as bad but there was no Waikato Regional Council independent assessors available to verify complaints.

Abatement Notice
An abatement notice is a formal, written directive. It is drafted and served by council staff instructing an individual or company to cease an activity, prohibit them from commencing an activity or requiring them to do something. The form, content and scope of an abatement notice is prescribed in statute.
Where multiple parties or a company are involved in the offending it is a good practice to serve a copy of the abatement notice on all parties, company directors and relevant managers.
It is an offence to fail to comply with an abatement notice.

In January & February 2013, Waikato Regional Council received 33 complaints alleging that the discharge of odorous compounds from Envirofert Limited's composting operation in River Road, Tuakau, North Waikato resulted in an objectionable effect beyond the site boundary.
The odour complaints were investigated & reported to a Waikato Regional Council Enforcement Decision Group on 6 March 2013. The decision makers at this meeting were Chris McLay (Group Manager, Resource Use Group), Rob Dragten (Division Manager, Compliance & Education), Patrick Lynch (Programme Manager, Investigations) and David Stagg (Programme Manager, Industry).
The decision of the Enforcement Decision Group is that the discharges of odour from Envirofert in January/February 2013 were in non-compliance with Condition 10 of Resource Consent 104419. 
Condition 1o states:There shall be no odours or particulate matter as a result of the activities authorised by this resource consent that causes an objectionable effect beyond the boundary of the site, being that land defined by Lot 1 DP 92347 and part Allotment 106 Parish of Tuakau. 
Condition 10 was mistakenly put in Waikato Regional Council documents as Condition 9. WRC have now remedied this. 
An Infringement Notice has been issued to Envirofert Limited for the alleged odours. (the alleged odours were verified by a WRC independent assessor) Two Abatement Notices have also been issued, as follows. 
Abatement Notice1 is a lawful direction for Envirofert to cease the discharge of contaminants, namely odorous compounds, into the air that  causes objectionable effect beyond the boundary of the site.
Since this abatement notice has been issued the community has had NONE of the odour complaints verified. The council are either unwilling or are again manipulating the Abatement Notice so Envirofert will look like they have fixed their problems.
Abatement Notice 2 is a lawful direction for Envirofert to engage a suitably qualified expert to prepare a report critically evaluating its composting processes and recommending improvement measures that the aim of reducing the emission odours that have an objectionable effect beyond the property boundary. This notice also requires Envirofert to undertake the recommend upgrade works and provide Waikato Regional Council with written confirmation when the improvements have been undertaken.
A decision on the compliance/non-compliance in regard to 'normal background odour' has not been made.
  Now we have been informed that the Council will make a decision on 'usual odour'. This being after the fact and with 4 years of composting stench. The 'usual odour' should have been determined before Envirofert started not after. 
Waikato Regional Council intends to put resources into making a determination as to compliance with that aspect when the timeframe of Abatement Notice 2 expires. (3 months)
A decision that will probably be made by some "experts" that do not live in Tuakau and without any input from the people that are suffering daily from Envirofert food waste composting smells.
After years of being told by the Council and Envirofert every time a "new" person started at Envirofert, they were "experts" in the field of composting, Envirofert have now been told by the Council to engage in a suitably qualified "expert". Even late 2012 we were told by the council that 2 experts were starting at Envirofert, Mike Lord previously from Perrys in Hamilton, lives in Cambridge and Andrew Corsbie, lives in Waiuku, claims he successfully ran a composting facility in the UK, (found to be lies from former boss, sacked)  now early 2014 Andrew Corsbie has left Envirofert.How many years does Tuakau have to put up with incompetent people at Envirofert while we are living with smells??  Envirofert got a resource consent change S127 to take food waste, in 2009, with a ONE windrow trial that NO ONE in Tuakau was told about and the "experts" said it could be done and the effects would be less than minor. Of course not one of these "experts" lives in Tuakau. These "experts" MUST be made accountable for their actions!!
The latest Waikato Regional Council document 'Consent Compliance Audit Report' for 1 July 2011 to 30 June 2012 wording of "experts" has been changed to "new Chief Executive (Mike Lord) and a new Operations Manager (Andrew Corsbie) left early 2014,both have considerable experience in environmental compliance". This was after Mike Lord told me personally that he was an expert in composting!!
We now have another new director on board, 19 February 2013 from Hamilton, with 'expert' advice, Kim Willoughby. He claims to successfully manage turnaround non-performing businesses. 3 directors Gary McGuire, Andrew Bayly and Kim Willoughby.
Where councils have, for their own undisclosed reasons, allowed a composting facility to exist too near a town, those facilities have continued to stink up the town and create breathing problems for residents through the circulation of mold and particulate matter. What is the councils going to do, to stop TUAKAU from stinking and being a health risk??

Driven by government targets,commercial composting is now turning into big business as a convenient way of dealing with millions of tonnes of organic wastes produced by New Zealand households and companies every year.
We live 1+kms away from Envirofert food waste composting facility in Tuakau,North Waikato,New Zealand and since they started taking food waste in 2009 we have had putrid odours permeating over Tuakau.
Waikato Regional Council issued Envirofert resource consent in 2009 on a one windrow trial. The council give this type of facility resource consents on the basis of reports done by air consultants,environmental planners  commissioned by the resource applicant saying "providing the procedures set out in the reports are adhered to, they consider that the effects will be less than minor." The councils seem to do very little if any at all worldwide research before these consents are granted. These consultant"experts" don't live here and are not having to put up with powerful stenches!
Then the council sit back and wait for the complaints to come in.Only then,will the council try to fix the problem. ODOUR COMPLAINTS 0800 800 402. We ring in with an odour complaint to the council,they take the details,the council ring the offending facility and WRC "sniffer" comes, by which time 15 mins to 3 hours can pass, they then do an odour assessment. It seems that the council's use this information against the odour complainer and never fix the odour issues, only that it looks like they are monitoring but in fact do nothing. Reports are done if an odour has been verified and the facility gets given warnings and infringement notices which then lead to the Environment Court where the offending facility may get fined. Very unusual. The facility just stick the one finger up at the community and go back to making odours. Every day is a new day to the council and odour producing facilities, so when you ring the next day with a complaint the council starts again, NOT ACCEPTABLE.
All of Enviroferts operations are done in the open air, nothing undercover or inside buildings so therefore the odorous smell and emissions are emitted over Tuakau,schools and parks. It is documented by the Scottish Environmental Protection Agency(SEPA) that the shredding and turning process involved in treating food/green waste may "give rise to bio aerosol emission." Bio aerosols can contain fungal spores and bacteria that are harmful to human health, and some people seem to be more susceptible than others. People with respiratory problems, asthma, and low immune may be at risk.
Commercial composting has until now been seen as an ideal solution because it takes large volumes of waste and turns it into soil improving compost.
However, potential risks are emerging. These facilities could and should be monitored to protect the surrounding area(Tuakau) from these risks. Just look at the history of asbestos which is now rearing its ugly head,some 30 years later!
While these facilities are making huge profits our property values are decreasing. Who wants to live in Tuakau when you can't even use your yard, entertain and washing needs to be rewashed.
