Residents Against Tuakau Smells(RATS) action community group was formed by a group of concerned residents of Tuakau, North Waikato(Franklin), New Zealand due to the community being fed up with the denials, excuses and neighbour blaming of ODOURS/DUST/POLLUTION from ENVIROFERT composting and clean?fill facility on River Road/Geraghtys Road and TUAKAU PROTEINS (Waikato By-Products) rendering plant on Lapwood Road.
This Blog is a way of getting information out to the residents that for many reasons do not want to complain or be named!

ENVIROFERT:
Environment Waikato & Franklin District Councils issued resource consents for a clean?fill operation in March 1999, after a joint hearing. Envirofert is owned & operated by GARY PETER MCGUIRE, TUAKAU Director & Shareholder & ANDREW HENRY BAYLY, KARAKA, (NOW MP FOR HUNUA)Director & Shareholder. Under their ownership, Envirofert has had numerous non-compliances, abatement notices, infringement notices, letters of direction and letters of warning!
2013-14 Gary McGuire leaves to train as a St Johns First Response Officer. Tuakau has been left with years of mistakes. Envirofert not built to approved application plan, bund built in wrong location, planned drain not built, now flooding neighbours land, numerous non compliances of consent conditions, unlawful dumping of waste, unlawful discharges to waterways and Waikato River.
2015 McGuire has been sacked from St Johns for disciplinary procedures.

1998 Land farming green waste was started.

2006 Complaints made by neighbours of drain contamination, product blowing onto neighbours land and height of clean?fill.
2008 Envirofert did a one windrow trial for food waste.
2009 Council granted a S127, (change to consent conditions) to take food waste. The reports was done by Tonkin+Taylor, Barker&Associates, and Air and Environmental Sciences Ltd. This change was granted by Waikato Regional Council on a non-notifying basis (community were not informed). Envirofert's neighbours (Waikato By- Products Ltd rendering plant)were doing upgrades and community were advised not to complain about odours while the upgrades were being done. WRC said 'timing was unfortunate' or was it?? McGuire was at the meeting that discussed the upgrades. Not seen at meeting for years.
2010 Envirofert was taken to Environment Court by neighbour with an Enforcement Order. Mediation and nothing achieved, lawyers involved!
2011 Envirofert went into partnership with Fonterra to do food destruction. Food that was past its sell by date, recipes gone wrong, food not fit for human consumption.

They also have 40+ years of on-going odour and noise issues. Rendering stinks, cooking smells, fan noise, dust pollution, smelly uncovered trucks and spillage, soon to do gelatine (so we are told)another odorous operation.

Many residents are now complaining about gas/sulphur/tip/waste odours in Bollard Road from Smart Environmental in Industry Lane and the Biodiesel Plant (originally from Carr Street)plant by the gas station.

Breaking News!!


Envirofert has been issued two Abatement  Notices by Waikato Regional Council  

Waikato Regional Council issued 2 Abatement Notices to Envirofert Food Waste Composting Facility on Thursday 4th April 2013 regarding offensive and objectionable odours.
These were verified complaints from January and February 2013.
The company was fortunate not to have March 2013 included as it was just as bad but there was no Waikato Regional Council independent assessors available to verify complaints.

Abatement Notice
An abatement notice is a formal, written directive. It is drafted and served by council staff instructing an individual or company to cease an activity, prohibit them from commencing an activity or requiring them to do something. The form, content and scope of an abatement notice is prescribed in statute.
Where multiple parties or a company are involved in the offending it is a good practice to serve a copy of the abatement notice on all parties, company directors and relevant managers.
It is an offence to fail to comply with an abatement notice.

In January & February 2013, Waikato Regional Council received 33 complaints alleging that the discharge of odorous compounds from Envirofert Limited's composting operation in River Road, Tuakau, North Waikato resulted in an objectionable effect beyond the site boundary.
The odour complaints were investigated & reported to a Waikato Regional Council Enforcement Decision Group on 6 March 2013. The decision makers at this meeting were Chris McLay (Group Manager, Resource Use Group), Rob Dragten (Division Manager, Compliance & Education), Patrick Lynch (Programme Manager, Investigations) and David Stagg (Programme Manager, Industry).
The decision of the Enforcement Decision Group is that the discharges of odour from Envirofert in January/February 2013 were in non-compliance with Condition 10 of Resource Consent 104419. 
Condition 1o states:There shall be no odours or particulate matter as a result of the activities authorised by this resource consent that causes an objectionable effect beyond the boundary of the site, being that land defined by Lot 1 DP 92347 and part Allotment 106 Parish of Tuakau. 
Condition 10 was mistakenly put in Waikato Regional Council documents as Condition 9. WRC have now remedied this. 
An Infringement Notice has been issued to Envirofert Limited for the alleged odours. (the alleged odours were verified by a WRC independent assessor) Two Abatement Notices have also been issued, as follows. 
Abatement Notice1 is a lawful direction for Envirofert to cease the discharge of contaminants, namely odorous compounds, into the air that  causes objectionable effect beyond the boundary of the site.
Since this abatement notice has been issued the community has had NONE of the odour complaints verified. The council are either unwilling or are again manipulating the Abatement Notice so Envirofert will look like they have fixed their problems.
Abatement Notice 2 is a lawful direction for Envirofert to engage a suitably qualified expert to prepare a report critically evaluating its composting processes and recommending improvement measures that the aim of reducing the emission odours that have an objectionable effect beyond the property boundary. This notice also requires Envirofert to undertake the recommend upgrade works and provide Waikato Regional Council with written confirmation when the improvements have been undertaken.
A decision on the compliance/non-compliance in regard to 'normal background odour' has not been made.
  Now we have been informed that the Council will make a decision on 'usual odour'. This being after the fact and with 4 years of composting stench. The 'usual odour' should have been determined before Envirofert started not after. 
Waikato Regional Council intends to put resources into making a determination as to compliance with that aspect when the timeframe of Abatement Notice 2 expires. (3 months)
A decision that will probably be made by some "experts" that do not live in Tuakau and without any input from the people that are suffering daily from Envirofert food waste composting smells.
After years of being told by the Council and Envirofert every time a "new" person started at Envirofert, they were "experts" in the field of composting, Envirofert have now been told by the Council to engage in a suitably qualified "expert". Even late 2012 we were told by the council that 2 experts were starting at Envirofert, Mike Lord previously from Perrys in Hamilton, lives in Cambridge and Andrew Corsbie, lives in Waiuku, claims he successfully ran a composting facility in the UK, (found to be lies from former boss, sacked)  now early 2014 Andrew Corsbie has left Envirofert.How many years does Tuakau have to put up with incompetent people at Envirofert while we are living with smells??  Envirofert got a resource consent change S127 to take food waste, in 2009, with a ONE windrow trial that NO ONE in Tuakau was told about and the "experts" said it could be done and the effects would be less than minor. Of course not one of these "experts" lives in Tuakau. These "experts" MUST be made accountable for their actions!!
The latest Waikato Regional Council document 'Consent Compliance Audit Report' for 1 July 2011 to 30 June 2012 wording of "experts" has been changed to "new Chief Executive (Mike Lord) and a new Operations Manager (Andrew Corsbie) left early 2014,both have considerable experience in environmental compliance". This was after Mike Lord told me personally that he was an expert in composting!!
We now have another new director on board, 19 February 2013 from Hamilton, with 'expert' advice, Kim Willoughby. He claims to successfully manage turnaround non-performing businesses. 3 directors Gary McGuire, Andrew Bayly and Kim Willoughby.
Where councils have, for their own undisclosed reasons, allowed a composting facility to exist too near a town, those facilities have continued to stink up the town and create breathing problems for residents through the circulation of mold and particulate matter. What is the councils going to do, to stop TUAKAU from stinking and being a health risk??

  4. This seems to be new terminology which no one knows how to establish what the air quality would have been before we started to get the foul air from Envirofert. Surely this needs to be determined by the residents and the council, not the consent holder and council. Lets hope that this is the way it is worked out. This sounds like a manipulation operation by people who play with the Resource Management Act(RMA)
    Even though Envirofert has 2 abatement notices from the Waikato Regional Council we are still living with various compost odours.
